Examining Increasing Health Plan Fee Litigation

The Johnson & Johnson Complaint

The allegations against Johnson & Johnson and its health plan fiduciaries have caused many employers and plan sponsors to take a closer look at their plans’ fees & costs, and their fiduciary obligations. This compliance panel with ERISA litigation attorney Tom Clark of The Wagner Law Group, and ERISA attorney Dan Kuperstein, will take a deeper dive into the Johnson & Johnson complaint, as well as examine other pertinent cases that give a more complete view of employers’ fiduciary responsibility in the health and welfare plan space.

In this live panel discussion, participants will:

  • Gain an understanding of what the Johnson & Johnson complaint means to employers like you.
  • Learn about the impact and implications of failing to supervise and monitor service providers’ compensation, under the CAA.
  • Learn best practices for ERISA fiduciary compliance, and strategies to avoid or minimize liability from excess fee litigation.
