The Transparency Tipping Point: CAA 2026 & PBM Reform’s New Regulatory Reality
The Consolidated Appropriations Act of 2026 (CAA 26) introduces sweeping PBM reforms and disclosure requirements. Beginning in 2028, it will require full rebate pass through, broader drug level and aggregate reporting, and a shift in PBM compensation to flat bona fide service fees. These changes reshape the contractual, fiduciary and financial landscape for employers and plan sponsors.
At the same time, the Department of Labor has proposed a new ERISA 408(b)(2) rule that would require detailed disclosures of all direct and indirect PBM compensation for self‑insured plans. The goal is to help fiduciaries assess the reasonableness of PBM arrangements and reduce opaque pricing.
All this is unfolding as AI rapidly transforms drug benefit administration, claim reporting and the broader healthcare ecosystem, creating new opportunities as well as new compliance challenges.
