Divorced/Separated? IRS Sets New Guidelines for Certain Employee Benefits
The Internal Revenue Service (“IRS”) has recently provided new guidance that will allow a child of parents who are divorced, separated or living apart to be treated as the dependent of both parents. In general, the IRS does not allow non-custodial parents to claim children as dependents for purposes of the dependency tax exemption. Under Internal Revenue Code Section 152(e), a child of divorced or separated parents will only be treated as a dependent of a non-custodial parent for tax exemption purposes if the custodial parent provides a written declaration that he or she will not claim the child as a dependent for the tax year. Additionally, the non-custodial parent must attach a copy of this declaration to his or her tax return.

President Bush Signs Legislation Expanding the Americans with Disabilities Act
On September 25, President Bush signed into law the ADA Amendments Act of 2008 (ADAAA or the Act), which passed both the House and Senate with bipartisan and near-unanimous support. The legislation had the approval of both the disabled and business communities. The new law, which becomes effective January 1, 2009, overturns several recent Supreme Court rulings that had limited the Americans with Disabilities Act (ADA), and as a result wipes out several employer defenses to ADA claims. Thus, the ADAAA is expected to alter in a major way how employers handle disability issues both in the workplace and in litigation.

Medicare Part D Notice of Creditable Coverage
November 15th is rapidly approaching! Plan sponsors are required to provide Notice of Creditable (or Non-Creditable) Coverage to their employees and their covered dependents that are Medicare-eligible. Individuals can enroll when they first become eligible for Medicare or each year from November 15th through December 31st.

New Jersey - NJDOL Publishes Proposed Regulations Concerning New Jersey's Paid Family Leave Law
Recently, the New Jersey Department of Labor and Workforce Development (NJDOL) issued proposed regulations aimed at implementing New Jersey’s Paid Family Leave legislation, the controversial new law signed by Governor Jon Corzine on May 2, 2008. The new law gives all employees up to six weeks of paid leave to care for a newborn, a newly adopted child or a sick relative. Benefits under the law will be provided through the State Disability Fund or private insurance plans. (Workers will begin making contributions to the Fund on January 1, 2009, and will be able to receive payment under the new law starting July 1, 2009.
